1. Introduction These Terms & Conditions (“Terms”) govern the use of our services provided by Book My Mechanic (“we,” “us,” “our”) and set forth the rights and responsibilities of users (“you,” “your”). By using our services, you agree to comply with these Terms.
2. Services Provided
(a) We provide a custom booking page integrated with Mechanic Desk.
(b) Our services include a one-time setup fee and a recurring monthly subscription fee as advertised.
(c) There is no minimum contract term; however, cancellation must be requested at least 7 days before the next billing cycle.
(d) The booking platform integration is owned and hosted by us and cannot be self-hosted or migrated to another provider.
3. Payment & Billing
(a) All payments are processed securely through Stripe.
(b) The setup fee is due upfront before any work begins.
(c) The monthly subscription fee is billed automatically and is due on the same date each month.
(d) Failure to make timely payments may result in service suspension or termination.
4. Cancellation & Refund Policy
(a) You may cancel your subscription at any time, with a minimum of 7 days notice. The service will remain active until the end of your current billing cycle.
(b) The setup fee is non-refundable once integration work has commenced.
(c) Monthly subscription fees are billed in advance and are non-refundable for partial months.
5. Service Availability & Maintenance
(a) We strive to maintain reliable service availability, but we do not guarantee uninterrupted service due to factors beyond our control.
(b) Scheduled maintenance may be required; we will notify users in advance where possible.
6. Data & Privacy
(a) We collect and store certain personal data as outlined in our Privacy Policy.
(b) We take reasonable measures to ensure confidentiality and security, but we are not liable for data breaches beyond our control.
7. Hosting & Data Management
(a) The booking platform is hosted on servers located in Melbourne, Australia.
(b) Users acknowledge that the booking system cannot be self-hosted or migrated away from our platform.
8. Limitation of Liability
(a) We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services.
(b) We do not accept responsibility for losses due to system downtime, third-party service disruptions, or user mismanagement.
9. Changes to Services & Pricing
(a) We reserve the right to modify or discontinue any part of our service, including pricing, with reasonable prior notice to users.
(b) Continued use of our services after changes take effect constitutes acceptance of the new terms.
10. Governing Law
These Terms are governed by the laws of Australia, and any disputes shall be resolved in the appropriate courts within Australia.
